{"id":9224,"date":"2015-11-17T18:27:45","date_gmt":"2015-11-17T18:27:45","guid":{"rendered":"https:\/\/forumarchives.tmsites.net\/index.php\/2015\/11\/17\/judge-wont-issue-order-to-keep-daily-fantasy-sports-in-ny\/"},"modified":"2015-11-17T18:27:45","modified_gmt":"2015-11-17T18:27:45","slug":"judge-wont-issue-order-to-keep-daily-fantasy-sports-in-ny","status":"publish","type":"post","link":"https:\/\/forumarchives.tmsites.net\/index.php\/2015\/11\/17\/judge-wont-issue-order-to-keep-daily-fantasy-sports-in-ny\/","title":{"rendered":"Judge won\u2019t issue order to keep daily fantasy sports in NY"},"content":{"rendered":"<p><!-- Original Post Content --><br \/>\nDeepti Hajela, Associated Press \u00b7 November 16, 2015 at 7:30 pm<\/p>\n<p>\t15<br \/>\n\tNEW YORK (AP) \u2013 A New York judge on Monday rejected the requests of daily fantasy sports operators DraftKings and FanDuel for temporary restraining orders to block the state attorney general\u2019s attempt to shut them down.<\/p>\n<p>\tIn separate complaints filed Friday in state Supreme Court in Manhattan, FanDuel and DraftKings first asked a judge for an injunction, arguing that Attorney General Eric Schneiderman wrongly characterized their businesses as illegal gambling operations.<\/p>\n<p>\tOn Monday, Boston-based DraftKings and New York-based FanDuel asked Justice Manuel Mendez for an immediate restraining order to stop Schneiderman until they can present their case. Each said they face irreparable damage otherwise.<\/p>\n<p>\tDraftKings said it has 375,000 New Yorkers among some 2.5 million players, and that the attorney general told its vendors in letters that it was at risk of not doing business in New York anymore.<\/p>\n<p>\tFanDuel said it has over 1 million users, with \u201chundreds of thousands\u201d in New York whose deposits it has been unable to process since Friday. The company blamed that on Schneiderman\u2019s office, saying it has already contacted the bank and payment processors handling FanDuel\u2019s customer deposits and withdrawals, deterring them from continuing.<\/p>\n<p>\tSchneiderman\u2019s lawyers told Mendez at a hearing late Monday that they hadn\u2019t done anything to actually prevent the companies from doing business in New York, and therefore he couldn\u2019t issue an order to stop it.<\/p>\n<p>\tMendez agreed. \u201cThey have not taken action yet to somehow enjoin the plaintiff from continuing to engage in their business here in New York,\u201d he said.
