The court granted the injunction. However, that may be the easiest part in the league’s fight against “sports gambling.”

The 32 NFL owners now must decide exactly what they oppose — a task that will be far more challenging than simply filing a lawsuit against the State of New Jersey.

Over the past few years, entrepreneurs from around the country have launched a wide range of online sports gaming contests that seek to blur the line between “sports gambling” and fantasy sports — an activity that the NFL actively endorses.

Among the newer formats of online sports gaming with some implicit NFL support seem to include “daily fantasy sports” contests, in which participants pay entry fees and compete for prizes based on their ability to predict player performances over a single day of games.

Some commentators historically have described “ daily fantasy sports” contests as akin to traditional sports gambling based on the short duration of the contests and the limited amount of interaction between players. Nevertheless, at least one NFL team, the New England Patriots, already maintains a sponsorship agreement with a “daily fantasy sports” website of this type.

Straying even further from the traditional notion of “fantasy sports,” the online start-up ScoreStreak recently launched a contest that allows users to predict which NFL players will achieve milestones on a given day in terms of touchdowns, receptions, and yardage. The NFL has not uttered a public word about this contest.

Even further still, the company TradeSports has begun to allow users to compete head-to-head based on their ability to predict a number of ‘yes or no’ bets based on a single NFL game — something that sounds similar to head-to-head parlay betting. The NFL has not uttered a public word about this contest either.

It is ironic that for all the NFL’s efforts to prevent sports gambling in New Jersey, it has ignored the far broader issue of the slow but steady dance by private entrepreneurs toward universal sports gambling on smartphones and handheld devices.

Perhaps the NFL has been foolish in expending so much time and effort to stamp out sports gambling at Monmouth Park Racetrack without articulating any coherent view on the online private sports gaming revolution.

Indeed, the NFL’s efforts to keep sports gambling out of Monmouth Park Racetrack will seem to achieve very little if those interested in online sports gaming can enter very similar contests from their own smartphones.

As the market for online sports gaming continues to emergence, the NFL is running out of time to define exactly what sort of sports gaming it finds problematic.

Replies:

No replies were posted for this topic.

Last week, NFL lawyers went to court to obtain a temporary injunction, preventing the State of New Jersey from offering sports gambling at Monmouth Park Racetrack.
