Prominent advertisements declared that "you can’t lose," with the promise that gamblers who gambled and lost $100 or more could have their losses reimbursed via free slot play, distributed over a period of time.
The drive was successful, with the casino experiencing a 33 percent increase in revenue compared to the same month the previous year, but the suit alleges that the rules, hidden in "virtually illegible" ultra-fine print, rendered the offer disingenuous, with its stipulations that the losses would be rebated in the form of "free play" slot dollars, distributed 5 percent at a time over 20 consecutive weeks, with no "full repayment" if any single week were missed. The resort has not commented on the lawsuit, filed Friday in Manhattan federal court.
